Chaudhury, who is elected to the Parliament from a seat reserved for the women, was appointed as the Speaker on Apr 30, eight months before the expiry of the government’s term.
Lawyer Yunus Ali Akhand filed the petition on Tuesday arguing that MPs from reserved seats could not be appointed Speaker.
Speaker Shirin Sharmin Chaudhury, secretaries of the Parliament Secretariat, Cabinet, and the Law Ministry have been made the defendants.
The petition sought a rule on why the gazette issued on the appointment should not be revoked and declared illegal.
Akhand also sought a directive to ask the Deputy Speaker to discharge the duties of the Speaker until the rule is resolved.
Shirin Sharmin Chaudhury replaced Md Abdul Hamid who was elected as the President after the death of Md Zillur Rahman.
Chaudhury will quit after the 10th Parliament is convened following the Jan 5 elections.
With her appointment as the Speaker, the three top positions of the ninth Parliament are being held by women.
Prime Minister Sheikh Hasina is the leader of the House, BNP Chairperson Khaleda Zia is the Leader of the Opposition and deputy leader of Parliament is also a woman, Awami League’s Syeda Sajeda Chowdhury.
She served as the state minister for women and children affairs before she was made the Speaker.
