EC reminds Home Ministry about SP Harun issue

The Election Commission has reminded the Home Ministry of the legal provisions regarding its recent notification issued to reinstated Harun-Ur Rashid as Superintendent of Police (SP) of Gazipur district.“A letter was sent on Thursday night to the Home Ministry just to remind it of the laws in this regard. Prior-consultation with the EC is required in case of transfer of such an official,” EC Secretary Sirazul Islam told UNB on Friday evening.
The EC on Thursday decided to send the letter to the Home Ministry mentioning legal provisions on the issue as its notification was not issued with prior-consultation with the Commission.
The letter was sent to Senior Secretary of the Home Ministry that contains the clause 89 of the Local Government (Union Parishad) Election Conducting Rule 2010.
As per the provision, DCs, SPs and UNOs and their sub-ordinate officials of the Union Parishad concerned cannot be transferred without consultation with the Election Commission until 15 days are elapsed after the election result is published in an official gazette.
The EC, in its letter, also mentioned that seven UPs of Kaliakair Upazila under the district are set to go to polls on May 7, while election schedule for one UP of the same upazila has already been announced and the balloting in the UP will be held on June 4.
As per the electoral rule, Harun-Ur Rashid can be restored as SP of Gazipur before the third week of June without consultation with the Election Commission.
Earlier on April 21, the EC issued a directive asking the Home Ministry to withdraw SP Harun-Ur Rashid from Gazipur and post a qualified official there. But on May 3, the Home Ministry issued a notification to reinstate Harun in Gazipur. The notification said the order will come into effect after the local government election 2016 is over.
