Dhaka, Dec 10 – The High Court (HC) Tuesday directed the jail authorities to produce Awlad Hossain, a program officer of Gonoshasthaya Kendra, before it on January 15 next year, who is now detained in Sherpur district jail after moving four courts following the alleged fake arrest warrant issued against him. The HC bench also directed the criminal investigation department (CID) of police to find out the culprits, who were involved in the process of issuing the fake warrant against Awlad Hossain, if there is any.
The HC bench comprising Justice M Enayetur Rahim and Justice Md Mostafizur Rahman came up with the orders after hearing on a writ petition filed Shahnaj Parveen, wife of Awlad, seeking its directive over the matter.
The HC bench also directed the chief judicial magistrate of Sherpur to grant his bail prayer after examining the documents on whether this court issued an arrest warrant against him or not.
The High Court also asked the chief judicial magistrate of Sherpur to take initiatives for his release after checking other arrest warrants if issued against him beyond the Sherpur court’s warrant.
According to the petition filed by the wife of Awlad that her husband had to move before the courts of Cox’s Bazar, Rajshahi, Bagerhat seeking bail due to the alleged fake arrest warrant issued against him. Now, her husband is staying in Sherpur jail on the same fake arrest warrant.
Advocate Zainul Abedin appeared in the court on behalf of the writ petitioner while deputy attorney general Amit Talukder stood for the state.
After the HC order, advocate Zainul Abedin said, “If the accused get a release before January 15, then he will come to the court himself, but if he can’t get bail before this time then the authorities will produce him before the HC bench in line with its today’s order.”
According to the case statement, Police arrested Awlad Hossain, a program officer of Gonoshasthaya Kendra, on October 30, 2019, from Ashulia area of Dhaka in a case filed in Nari O Shisu Tribunal no-1 of Cox’s Bazar.
Then he filed a bail application and upon hearing a Dhaka Court rejected his petition and ordered to send the case documents to the court of Cox’s Bazar.
The Nari O Shisu Tribunal of Cox’s Bazar on November 13 this year said there was no accused named Awlad Hossain.
After receiving the Cox’s Bazar Court order the jail authority of Dhaka Central Jail said that they have been asked to produce Awlad Hossain in a Tribunal of Rajshahi as there is an arrest warrant against him. But, the Rajshahi court released him on November 24.
But, he was later produced in the court of Bagerhat and now scheduled to be produced on December 16 in a Sherpur court.
Mr Awlad Hossain is now in Sherpur district jail since December 2, said a concerned lawyer.
In this circumstance, Awlad Hossain’s wife Shahnaj Parveen filed a writ petition with the High Court seeking necessary order in this regard. – Staff Reporter
