High Court issues rule for law on constituting Election Commission

The High Court has pulled up the government over formulating a law on constituting the Election Commission (EC).On Monday, the bench of justices Jahangir Hossain and Md Jahangir Hossain issued a rule asking why the government would not be directed to make a law under the Constitution’s Article 118.

Cabinet secretary, law secretary and the Election Commission have been told to come up with explanations by four weeks.

The order came after initial hearing of petition filed by Supreme Court lawyer Yunus Ali Akand.

He told bdnews24.com Article 118 stipulates a law for forming the Election Commission, which is yet to be formulated. “A key Constitutional body cannot operate like this.”

The Kazi Rakibuddin Ahmad-led EC’s term expires in February.

President Md Abdul Hamid has formed a search panel to forward recommendations for election commissioners following talks with political parties, just like his predecessor the late Zillur Rahman done in 2012.
