The college admission guidelines of the Education Ministry has been suspended only for Notre Dame College, the Appellate Division of the Supreme Court ruled on Monday.This effectively eliminates any restrictions on college admissions without entrance examinations for any other colleges, said a state lawyer.
Chief Justice Md Muzammel Hossain-led 5-judge bench amended the High Court order on the issue.
The HC’s rule has been directed to the bench of Justice M Moazzem Husain asking for disposal of the case within four weeks.
On May 16, the Education Ministry issued guidelines for college admissions throughout Bangladesh, where no entry examinations were required.
Students were to be enrolled on basis of GPA obtained in Secondary School Certificate (SSC) examinations.
But, Notre Dame College authorities filed a petition with the High Court challenging the guidelines.
In response, on Jun 2, the court suspended the effect of the issued guidelines for six months.
The bench of Justice Moazzem Husain and Mohammad Habibul Gani also issued a rule seeking explanation as to why the guidelines will not be declared illegal.
As a result, eleventh-grade or college admission results were stopped across all educational institutions under Dhaka board.
Thye list of nominations were scheduled to have been announced on Sunday.
On Sunday, a Dhaka Board press release explained they had stopped admission to comply with the court directives.
“Further information will be provided after next orders,” it said.
Meanwhile, the Dhaka Education Board filed a petition challenging the High Court ruling, which the Chamber Judge forwarded to regular bench of the Appellate Division on June 5.
On Monday, the Chief Justice-led appellate bench corrected the High Court ruling after hearing.
Attorney General Mahbubey Alam represented state while M Zahir represented Notre Dame College.
Deputy Attorney General Mohammad Ekramul Haque Tutul told bdnews24.com that the full bench of Appellate Division had ruled that the stay order on Ministry guidelines will be effective only for Notre Dame College.
“This effectively removes barriers to college admissions in other educational institutions.”
