Dhaka, Dec 13 – The High Court on Wednesday issued a rule asking the authorities concerned to explain why the misuse of the mobile court out of personal grudge should not be declared illegal.The HC bench of Justice Quazi Reza-Ul Hoque and Justice Mohammad Ullah issued the rule while discharging its previous rule accepting the unconditional apologies sought by the two government officials of Laxipur district this morning.
HC asked authorities concerned for not posting the additional deputy commissioner (ADC) of Laxmipur and UNO of the district’s Sadar Union in such places where they cannot get an opportunity to abuse power.
The court, in its observation, said, “We are asking secretaries for Law, Public Administration and Home not to post them in such a place so that they can abuse of their power.”
The court, in its order, also commented that the mobile court is being operated sitting in the office and abusing its power.
It also asked the former civil surgeon of Laxmipur Dr Salahuddin Sharif to do behave wisely.
Earlier in the day, the duo – ADC Sheikh Morshedul Islam and UNO Kamruzzaman – sought unconditional apology to the High Court over three-month imprisonment of former civil surgeon of the district allegedly for assaulting the ADC.
On December 5, the High Court summoned the duo to appear before the court at 10:30 am on December 13 and explain the three-month imprisonment of former civil surgeon of the district allegedly for assaulting the ADC.
The court came up with the order following a writ petition filed by Supreme Court lawyers Advocate Kamal Hossain Niazi and Advocate Ashfaqur Rahman.
Earlier on December 4, former Civil Surgeon of Laxmipur Dr Salahuddin Sharif was sentenced to three months imprisonment by the mobile court, led by Sadar Upazila Nirbahi Officer (UNO) Kamruzzaman, for allegedly assaulting Sheikh Morshedul.
Dr Salauddin and Morshedul went to kindergarten Kakoli Shishu Angan in the district town to pick up their grandson and son respectively around 10:15 am. The duo locked into a brawl following shoving at the crowded school gate.
At one stage of brawl, the ADC slapped the retired civil surgeon and he also retaliated by doing the same.
Later, police detained Dr Salauddin and produced him before the mobile court which handed down the verdict.
Meanwhile, a Laxmipur court later granted bail to the former civil surgeon on a bond of Tk 5,000.
Mir Shawkat Ali, additional district magistrate (ADM), passed the order after Rasel Mahmud Manna, lawyer of Dr Salahuddin Sharif, filed the bail petition. – UNB
