Hearing on Jamaat registration adjourned

The larger bench of High Court division on Tuesday adjourned until April 18 the hearing on a rule following a writ petition against the registration of the Bangladesh Jamaat-e-Islami as a political party. An HC bench comprising Justice M Moazzem Hossain, Justice M Enayetur Rahman and Justice Dr Kazi Rezaul Haque passed the order after hearing in favor of the writ for second day.
Barrister Tania Amir moved for the writ while Barrister Belayet Hossain and Advocate Farid Uddin Khan were present in the court on behalf of Jamaat-e-Islami.
Earlier on April 11, Election Commission submitted it’s explanation in the form of declaration on oath and the final hearing started on the day. On March 11, the court also asked the election commission and Jamaat authorities to explain the rule issued seeking explanation why the registration of the party “should not be declared illegal within the stipulated time” by April 9.
On March 10, the Chief Justice constituted a larger bench headed-by Justice M Moazzem Hossain to resolve the pending writ petition against the registration of the Bangladesh Jamaat-e-Islami as a political party.
Earlier in the day, the High Court sent the writ petition filed against the registration of the Jamaat-e-Islami to the Chief Justice with a request to form a larger bench for hearing.
The bench referred the petition to the CJ citing that the matter is related to constitutional and legal interpretation and should be dealt with by a larger bench.
Barrister Tania Amir moved for state while Barrister Abdur Razzak stood for Jamaat.
On January 25, 2009, Bangladesh Tarikat Federation filed the writ petition with the High Court challenging legality of Jamaat’s registration.
On January 27, 2009, an HC division bench led by Justice ABM Khairul Haque had issued a rule for six week asking the election commission and Jamaat authorities to explain why the registration of the party “should not be declared illegal”.
Jamaat Ameer Motiur Rahman Nizami, Secretary General Ali Ahsan Muhammad Mujahid and Election Commission secretary were made the respondents to the rule.
