Dhaka – BNP on Thursday said taking oath by the newly elected MPs before January 24 when the tenure of the ninth parliament will expire is a clear violation of the Constitution.
“According to the Constitution, so-called persons elected in the so-called January-5 election cannot take charge unless the current parliament expires on January 24,” BNP acting secretary general Mirza Fakhrul Islam Alamgir said in a statement.“But they (newly elected MPs) took the charge as members of parliament taking oath today. It’s a gross violation of the Constitution,” he said.
The Speaker also violated the Constitution administering oath to the newly elected MPs as there was no scope for administering oath today in line with the Constitution, the BNP spokesperson said.
It can be stated unequivocally that it’ll be also a deviation of the Constitution by the President if he calls the Leader of the House elected by such MPs to form the government, he added.
“Everything happened just for capturing and lingering power. All involved with the process must be accused of setting a bad example of violating the Constitution power,” the BNP leader said.
Fakhrul also urged all the concerned to be conscious to uphold the Constitution. “Those who did such deviation of the constitution, they should remember that they themselves inserted a provision of harsh punishment in the Constitution for its deviation through the 15th amendment to it.”
Those who were sworn in as MPs being elected through a voter-less election that was rigged not only tainted the holy Parliament and democracy, but also betrayed the people blatantly, he said.
The BNP acting secretary general also reminds: “Time will come oneday when people will give a befitting reply to the farce.” – UNB
