Bd High Court rejects writ challenging oath by new MPs

Dhaka, Feb 18 – The High Court on Monday rejected a writ petition filed challenging the legality of oath taking by lawmakers elected in the 11th parliamentary election held on December 30 last year.
The HC bench rejected the petition saying that there was no violation of the constitution by administrating oath of lawmakers as the new MPs entered into the parliament on January 30 when the first sitting of 11th parliament resumed after dissolving the previous parliament.
The HC bench comprising Justice Sheikh Hassan Arif and Justice Razik-Al-Jalil came up with verdict saying that there is nothing illegal in taking oath taken by the lawmakers as they took charges of their offices on January 30.
Barrister AM Mahbub Uddin Khokan, counsel for the petitioner, told reporters that they would file an appeal against the High Court decision as the Constitution was violated by administration of oath of new MPs before dissolving the previous parliament.
During the hearing on the petition, Khokan told the court that oath taking by the lawmakers on January 3 was unconstitutional as the tenure of the 10th parliament expired on January 28.
“Therefore, there were two parliaments from January 3 to January 28 — which is unconstitutional,” he added.
On the other hand, Attorney General MahbubeyAlamhad opposed his submission and told the court that as new lawmakers took charge on January 30, oath taking was not illegal.
Supreme Court lawyer Taherul Islam filed the public interest litigation with the HC on January 4 challenging the legality of the swearing in.
The HC had on February 6 concluded the hearing on the petition and fixed yesterday (February 18) for passing its order on the petition.
The High Court on January 17, scrapped a similar writ, saying it was ‘not pressed’. After that this writ was filed, which was summarily rejected by the High Court yesterday. – Staff Reporter
