Dhaja, July 31 – In a verdict, the High Court on Tuesday issued 9-point directives over the requisition of vehicles including that police could not requisite private cars, CNG-run auto-rickshaws and taxis.The HC bench comprising Justice Naima Haider and Justice Khijir Ahmed Chowdhury came up with the verdict after completing final hearing on writ petition filed by Advocate Manzill Murshid on behalf of Human Rights and Peace for Bangladesh.
In its verdict, the HC bench said that all requisition of vehicles must be for the public interest and if it is not for public interest, legal action must be taken against the responsible police officer.
The requisitioned vehicle cannot use for personal or family purpose of any police official. If anyone found do it, it would be consider as misconduct and appropriate action must be taken to this effect.
It also said that private cars, CNG auto-rickshaws and taxis cannot be requisitioned.
The HC verdict also said that every police station have to maintain a list of requisitioned vehicles.
If any allegation is filed about requisition of transport, the metropolitan police commissioner will investigate and take necessary action in this regard, according to the HC verdict.
It also said that a vehicle could not be requisitioned more than one time within six months.
The HC said that if any requisitioned transport is damaged then the police will compensate the owner of the vehicle.
It also said that police has to bear the cost of fuel of the requisitioned vehicle and food cost of the driver.
The transport carrying women, children and patients cannot be requisitioned. Dhaka Metropolitan Police Commissioner will issue a circular that the police officers follow the directive.
The HRPB filed the writ in 2010, challenging section 103A of The Dhaka Metropolitan Police Ordinance, 1976. After final hearing on the rule issued by it earlier, the HC bench yesterday came up with the directives.
Advocate Manzill Murshid appeared on behalf of his petition while advocate Mostaque Ahmed moved for Dhaka metropolitan police during the hearing on the petition. – Staff Reporter
