Bd ex-district judge fined for not giving HC judge protocol

Dhaka, Feb 13 – The High Court on Wednesday fined a former district and sessions judge of Feni Tk 5,000 for not providing a protocol to the then High Court Judge Justice Syed Amirul Islam in the district in 2003.
The HC said Feroz Alam, then district and sessions judge of Feni will have to serve in jail for seven days if he does not pay the fine within 15 days.
The HC bench comprising Justice Obaidul Hassan and Justice SM Kuddus Zaman came up with the verdict after disposing of a suo moto rule issued by it in 2003.
In 2003, the then HC Justice Syed Amirul Islam went to Feni in 2003 for a visit. As per the warrant of precedent, the district and sessions judge is supposed to provide a protocol to a judge of the Appellate and
HC Divisions when they go out of Dhaka, but the then District and Sessions Judge Feroz Alam of Feni did not give protocol to Justice Syed Amirul Islam although he was informed about the visit.
Then a HC bench issued a suo moto rule against Feroz Alam at that time.
After holding hearing on the rule the HC yesterday delivered the verdict.
In its verdict, the HC yesterday issued some directives for the district and session judges and the district administrations about giving protocol to the Supreme Court judges when they are on visit.
If the HC judge will go in any district for visit during the vacation day, at least a district judge level judicial officer will have to felicitate the HC judges in the circuit house of the district.
If the HC judges will go to visit in any district during the working days and official time, the judge in charge Nejarat will felicitate the HC judges in absence of district judge. After completing of
official time, the district and session judge will meet a courtesy call with the HC judge.
If the HC judge will stay in village, a senior official will look after the HC judge, according to the HC observation.
The district and session judge and additional district and session judge must present during the leaving of HC judge from the visiting area. Deputy Commissioner (DC) and Superintendent of police or their
representative also be present at that time, the HC verdict said.
The registrar general of the Supreme Court has been asked to issue a circular mentioning the HC directive in this regard.
Deputy attorney general Rafi Ahmed appeared for state while Advocate Faisal H Khan appeared for the district judge during the rule hearing. – Staff Reporter
