HC stays gazettee revokling ’71 Sp’l Guerilla Force List

The High Court on Monday stayed for three months the operation of the gazette notification revoking the list of special guerilla force (SGF) recruited from NAP-Communist Party and Chhatra Union during the Liberation War in 1971.
Passing the interim order, an HC division bench comprising Justice Salma Masud Chowdhury and Justice M Khasruzaman issued a rule asking the government to explain in four weeks why the impugned 2014 October 29 gazette notification should not be declared to have been made without lawful authority.The HC came up with the orders after a preliminary hearing on a writ petition filed by Pankaj Bhattachariya, an SGF deputy commander and Oaikya NAP president, challenging the validity of the gazette notification.
The Secretary of the Liberation War Affairs Ministry, its Deputy Secretary and Director General of National Freedom Fighters’ Council have been made respondents to the rule.
Advocate Zahidul Bari, assisted by Tobarak Hossain and SA Sabur, appeared for the writ petitioner. – UNB
