The High Court has pulled up three secretaries for contempt of court after they did not respond to a court order.The court had requested a clarification as to which law on child repression would apply to several cases.The bench of justices M Enayetur Rahim and JBM Hassan delivered the ruling on Monday, said Deputy Attorney General Sheikh AKM Maniruzzaman Kabir.
From the State’s records it was discovered that four adults charged in as many cases of child rape and murder in Dhaka, Cox’s Bazaar and Rangpur had applied for bail to the high court.Two of the cases had been filed under the Child Law, while the others had been filed under the Women and Children Repression Prevention Law.There was no explanation about why the similar cases had been filed under two separate laws, said the deputy attorney general.On Aug 14 the court ordered the three secretaries to provide an explanation over the discrepancy by Sep 7.As no explanation has been received, the three are now pulled up for contempt of court.“The problem is that the sentences for the two crimes are different,” said Kabir.The law ministry’s Legislative and Parliamentary Affairs Secretary Md Shahidul Haq, Law and Justice Division Secretary Abu Saleh Sheikh Md Jahirul Haq and Social Welfare Secretary Md Zillar Rahman have been ordered to respond within three weeks.
