SC stays on HC’s order for transfer of Sakhipur UNO

Dhaka-The Supreme Court on Wednesday stayed for four weeks a High Court order for transferring Sakhipur Upazila Nirbahi Officer (UNO) Mohammad Rafiqul Islam and officer-in-charge of Sakhipur Police Station Mohammad Maksudul Alam in Tangail over sentencing a schoolboy.
Chamber Judge of the Appellate Division Justice Hasan Foez Siddique passed the order following two petitions filed by the UNO and the OC.
It also asked the petitioners to file a leave-to-appeal petition against the HC order, said Yusuf Hossain, a counsel of UNO.
On September 20, the High Court summoned the Sakhipur UNO and Sakhipur Police Station OC to explain why the jail term sentenced by the UNO to a schoolboy for posting offensive comment about local MP Anupam Shajahan Joy on facebook should not be declared illegal.
On October 18, the High Court asked the authorities concerned to conduct judicial investigation against the UNO and OC and acquitted Sabbir after declaring the two-year jail term awarded by the UNO to him illegal.
It also ordered transfer of the UNO and OC outside Dhaka division.
A mobile court on September 17, led by Executive Magistrate Mohammad Rafiqul Islam of Sakhipur upazila in Tangail sentenced Sabbir Shikder to two years’ imprisonment on charge of uploading a message of threat to Anupam Shajahan Joy, MP of Tangail-8 (Basail-Sakhipur) constituency, on the social networking site Facebook messenger.
Police arrested Sabbir on September 16 following a general diary filed by the MP.
According to the GD, Sabbir, son of Shahinoor Alam of Protima Bonki village, wrote in his Facebook account pointing at the MP, “Your time is going to end.”
