The Supreme Court on Tuesday stayed for six weeks the High Court order that asked the authorities concerned to shut the shops of Mouchak Market in the city, terming the building risky.Chamber Judge of the Appellate Division of the Supreme Court Justice Mirza Hossain Haider passed the order responding to a petition filed by Mouchak Market Shop Owners’ Association against the High Court order.
The court said shop owners can run their shops for the six weeks’ stay order, but they will have to take the responsibility if any untoward incident takes place due to the risk factor in the building. Earlier, on Monday, the HC ordered the authorities concerned to shut the shops of Mouchak Market terming its building risky after hearing on a writ petition filed by building owner Ashraf Kamal Pasha. Dhaka, UNB News Agency Reported.
The court asked the Housing and Public Works Secretary and Rajuk to carry out the order. The court said on Monday the shops will have to be kept closed until completion of renovation work as per the recommendations of Buet and getting clearance from the authorities concerned.
On May 7 2014, Rajuk served a notice on the Mouchak Market owner declaring the building risky and asked them to examine its capacity by Buet experts.As per the recommendations of Buet, Rajuk on May 2 asked the market authorities through a letter to renovate the building.
Building owner Ashraf filed the writ petition with the High Court challenging the Rajuk order.
